Architectural Guidelines & Checklist

Covenants and Restrictions (CCRs) are encumbrances on property and have the force of law. Shadowood’s CC&Rs were placed on the property by First Federal Savings and Loan’s development company and approved by the City of McMinnville at the time the subdivision application was submitted. The CC&Rs require compliance with a set of Bylaws, which were prepared by the development company, and a Board of Directors that administers the rules, regulations and finances of the homeowners association.

Please take the time to familiarize yourself with the CC&Rs and Bylaws of the Shadowood Greenways Development. The title company that closed your property transaction should have copies of the CC&Rs, and, of course, both the CC&Rs and Bylaws of the development are posted on the Shadowood Greenways website.

The Architectural Guidelines and Checklist below are referenced in your Shadowood Greenways Covenants and Restrictions under Articles VII and IX. They have been adopted for the purpose of maintaining the quality and character of the Shadowood Greenways development and the property value of our homes. They may be amended from time to time by the Architectural Committee with approval by the Board of Directors.

An Architectural Update/Modification Request Form (found under ‘Policies and Procedures’ on the website) is to be completed and submitted to the Committee for approval BEFORE any changes are made to the exterior of the property.

TO THE ARCHITECTURAL COMMITTEE:

If there is a conflict between the homeowner and the Architectural Committee that cannot be resolved, the Board of Directors must be consulted by the committee for a resolution prior to approval.

Since the Architectural Committee is governed by our CC&Rs, the Board of Directors requires the committee chair or their agent to attend and give a report on the Request to Modify approvals and denials at every board meeting, as well as any other actions the committee has engaged in since the previous meeting.

SHADOWOOD GREENWAYS ASSOCIATION ARCHITECTURAL GUIDELINES

Lot owners will not paint, construct, alter or maintain any improvement on the premises until:

  1. they have submitted a set of plans and specifications on an Architectural Update/Modification Request Form to the Architectural Committee, and
  2. such plans and specifications have been approved in writing by the committee. If such plans are not approved within forty-five (45) days from the date of submission or the committee fails to notify the homeowner of its objections, then such plans and specifications shall be deemed to have been approved.

DEFINITIONS

“Consistent”, as used in the CC&Rs, Article VII (b), means the most current color palette and language proposed by the Architectural Committee (which must be approved by the Board of Directors).

“Grandfathered” is defined as the same color currently on the stand-alone homes. [Townhome building colors are designated by the Architectural Committee.]

SHADOWOOD GREENWAYS ASSOCIATION ARCHITECTURAL CHECKLIST

These are general requirements and shall be followed except as otherwise approved by the Architectural Committee. Every homeowner must submit a form and receive committee approval before proceeding with any work.

  1. Plans for new constructions or alterations and modifications of existing structures should include, where applicable and appropriate:

a) Dimensions and exact location of any exterior improvements, including outbuildings.

b) Structural drawings and exterior design.

c) Exterior colors.

d) Material, design, color and location of any proposed fences and/or gates

e) Front yard landscaping layout. (Backyard improvements are not governed by the HOA unless they are visible from the street.)

2. Specifications– a description of building materials and supplies to be used in construction that is equivalent in detail to FHA minimum requirement list.

3. Building Restrictions, CC&Rs, Article IX – These restrictions were primarily placed for the initial construction in the development. Sections 1, 2 and 3 restrictions have been met by the construction of those homes and are here as a guide for the future.

Section 1 :  Maximum Building Height – the peak of the roof shall not exceed 28 feet as measured from the nearest curb.

Section 2 :  Square feet to be contained in single family residence – the minimum number of square feet in a detached single family residence shall be no less than 1300 square feet. The minimum square feet in a townhome shall not be less than 800 square feet of living area.

Section 3 :  Set-back requirements – the minimum side yard requirement for single family lots shall be 7½ feet. Front and rear yard minimum set-back requirements shall be 10 feet. Set-backs in front of garages shall be 20 feet in order to provide for vehicle parking.

Section 4 :  Restrictions on carports – no carports shall be allowed in the development including canopies used as such. Parking shall be provided by means of entirely closed parking garages.

Section 5 :  Exterior colors – approved paint colors may be found on the website under Policies and Procedures – Shadowood Color Palette. Garage doors and front doors must complement the main color. For townhomes, each building must be consistent with the color palette for that structure. Every homeowner must submit a form and receive committee approval before proceeding with any work.

Section 6 :  Roofing – the preferred roofing material shall be composite shingles. For all structures, including townhomes, each unit in that structure must be consistent with the approved color palette and specifications of the Architectural Committee and, ultimately, the Board of Directors. Each townhome must maintain the same wall and trim color, as well as the same color of shingled roofing on the structure.
