Covenants and Restrictions (CCRs) are encumbrances on property and have the force of law. Shadowood’s CC&Rs were placed on the property by First Federal Savings and Loan’s development company and approved by the City of McMinnville at the time the subdivision application was submitted. The CC&Rs require compliance with a set of Bylaws, which were prepared by the development company, and a Board of Directors that administers the rules, regulations and finances of the homeowners association.
Please take the time to familiarize yourself with the CC&Rs and Bylaws of the Shadowood Greenways Development. The title company that closed your property transaction should have copies of the CC&Rs, and, of course, both the CC&Rs and Bylaws of the development are posted on the Shadowood Greenways website.
The Architectural Guidelines and Checklist below are referenced in your Shadowood Greenways Covenants and Restrictions under Articles VII and IX. They have been adopted for the purpose of maintaining the quality and character of the Shadowood Greenways development and the property value of our homes. They may be amended from time to time by the Board of Directors.
A “Request to Modify” form (found here) is to be completed and submitted to the Committee for approval before any changes are made to the exterior of the property.
GUIDELINES
Lot owners will not paint, construct, alter or maintain any improvement on the premises until:
- They have submitted a set of plans and specifications on a “Request to Modify” form to the Architectural Committee, and
- such plans and specifications have been approved in writing by the committee. If such plans are not approved within forty-five (45) days from the date of submission or the committee fails to notify the homeowner of its objections, then such plans and specifications shall be deemed to have been approved.
DEFINITION
“Consistent,” as used in the CC&Rs, Article VII (b), means the most current color palette and language proposed by the Architectural Committee (which must be approved by the Board of Directors).
CHECKLIST
The following requirements are furnished to lot owners to assist them in complying with the general requirements set forth in the CC&Rs recorded when the subdivision was platted.
These are general requirements and shall be followed except as otherwise approved by the Architectural Committee.
- Plans for new constructions or alterations and modifications of existing structures should include, where applicable and appropriate:
a) Structural drawings and exterior design
b) The size and dimensions of any exterior improvements including outbuildings
c) The exterior color scheme
d) The exact location of the improvement on the home site
e) The location of driveways
f) Material, design, color choice and location of any proposed fences and/or gates
g) The front yard landscaping layout.
2. Specifications: A description of building materials and supplies to be used in construction that is equivalent in detail to FHA minimum requirement list.
3. Building Restrictions, CC&Rs, Article IX: These restrictions were primarily placed for the initial construction in the development. Sections 1, 2 and 3 restrictions have been met by the construction of those homes and are here as a guide for the future.
Section 1 : Maximum building height: The peak of the roof shall not exceed 28 feet as measured from the nearest curb.
Section 2 : Square feet to be contained in single-family residence: The minimum number of square feet in a detached single family residence shall be no less than 1300 square feet. The minimum square feet in a townhouse shall not be less than 800 square feet of living area.
Section 3 : Set-back requirements: The minimum side yard requirement for single family lots shall by 7½ feet. Front and rear yard minimum set-back requirements shall be 10 feet. Set-backs in front of garages shall be 20 feet in order to provide for vehicle parking.
Section 4 : Restrictions on carports: No carports shall be allowed in the development including canopies used as such. Parking shall be provided by means of entirely closed parking garages.
Section 5 : Exterior colors: Approved paint colors may be found on the website under Shadowood Color Palette. For multi-family buildings, each unit in that structure must be consistent with the color palette for that structure.
Section 6 : Roofing: The preferred roofing material shall be composite shingles.
For all structures, including multi-family, each unit in that structure must be consistent with the approved color palette and specifications of the Architectural Committee and, ultimately, the Board of Directors.
